Article 1. General
1.1. “ohumm.com”, “myohumm.com” refers to Ruffles & Co C.V.
1.2. These terms apply to all offers and agreements with ohumm.com unless explicitly stated otherwise in writing.
1.3. They also apply when third parties are engaged for execution.
1.4. Unless otherwise agreed, third-party terms are not recognized.
1.5. If there is a conflict between these Terms and an Agreement, the Agreement prevails.
1.6. If any clause is invalid, the rest remains effective; both parties will replace the invalid clause by mutual agreement.
Article 2. Offers and Agreement Formation
2.1. All offers are non-binding unless stated otherwise.
2.2. Agreements become binding only after written confirmation by ohumm.com.
2.3. If not contested within 8 days, written confirmation is final.
2.4. Offers do not automatically apply to repeat orders.
2.5. ohumm.com is not bound by obvious errors or typos.
2.6. Changes or additions are valid only in writing.
Article 3. Prices
3.1. Prices are in Euros, including VAT. International buyers are responsible for local taxes and import duties.
3.2. No price increase will occur after agreement unless due to legal requirements.
3.3. Consumers may cancel the contract if non-legal price increases occur.
Article 4. Delivery
4.1. Items in stock are shipped immediately after payment. Delivery occurs to the registered address and must be received by a person 18+.
4.2. The recipient must sign upon delivery.
4.3. If delivery is refused or delayed, goods are stored at the buyer’s risk and expense.
4.4. Delivery is considered complete once offered once.
4.5. Refusal costs (return, storage, damage) are borne by the buyer.
Article 5. Delivery Time
5.1. Delivery times are estimates, not guarantees.
5.2. ohumm.com aims to deliver within 30 days. If not possible, customers are informed within a month and may cancel free of charge.
Article 6. Cancellation
6.1. ohumm.com may suspend or cancel the agreement if there are reasons to believe the buyer will not fulfill obligations (e.g., bankruptcy, liquidation).
6.2. ohumm.com may also cancel if performance becomes impossible due to external circumstances.
6.3. Consumers may cancel within 7 working days after delivery (right of withdrawal), provided the product is unopened and unused.
Opened or tampered bottles cannot be returned for safety reasons.
Returns must be announced within 7 days and shipped back within 10 days at the buyer’s expense. Refunds are made within 30 days of receiving the returned product in perfect condition.
Article 7. Force Majeure
7.1. Force majeure includes unforeseen events (e.g., strikes, internet or power failures).
7.2. This applies even if the event occurs after the obligation was due.
7.3. If force majeure lasts more than 2 weeks, either party may cancel without damages.
7.4. Partial delivery may still be invoiced if it has independent value.
Article 8. Warranty
8.1. ohumm.com provides only the manufacturer’s warranty.
8.2. Not responsible for product suitability or advice.
8.3. The buyer must check products immediately upon receipt and report defects within 1 month.
8.4. ohumm.com may replace items or refund up to the invoice amount or insurance coverage.
8.5. Not liable for damage caused by non-supervisory staff.
8.6. Warranty void if:
A) Buyer is in default.
B) Buyer or third party altered/repaired items.
C) Items misused or stored improperly.
D) Defects caused by government-imposed standards.
8.7. Vintage years shown on the website are not binding.
Article 9. Payment
9.1. Payment must be made in advance via Credit Card, PayPal, iDeal, or Bank Transfer.
Cash on delivery (COD) is possible for an additional fee.
9.2. Late payments (after 10 days) incur 1% monthly interest.
9.3. In case of bankruptcy or suspension of payment, all claims become due immediately.
9.4. Collection fees: 15% of the amount due, minimum €250.
9.5. Proven additional costs are also recoverable.
Article 10. Retention of Ownership
10.1. All goods remain the property of ohumm.com until full payment is received.
10.2. Resale is allowed only in normal business operations.
10.3. Goods cannot be pledged or encumbered.
10.4. ohumm.com may reclaim goods in case of non-payment.
10.5. Buyer must inform ohumm.com if goods are seized by third parties.
10.6. Buyer must insure goods against damage and theft.
Article 11. Privacy
11.1. ohumm.com respects your privacy and will not sell or share your data, except as stated here.
11.2. Personal data provided voluntarily may be used to improve service and communication.
11.3. Non-personal visitor data (browser, OS, etc.) may be collected for analytics.
Personal data can be deleted upon request unless it causes disproportionate effort.
Article 12. Intellectual Property
12.1. All intellectual property rights remain with ohumm.com or its suppliers.
12.2. Both parties agree to confidentiality regarding private information.
12.3. The website’s texts, images, and code may not be copied or altered without written consent.
Visitors must fully respect ohumm.com’s intellectual property rights.
Article 13. Applicable Law
All offers and agreements are governed by Dutch law.
The Vienna Sales Convention does not apply.

Complaints are normally handled within 30 days.
If this is not possible, customers will be informed of the delay.
